Avrupa Konseyi İstanbul Sözleşmesi Onaylandı

 

Türkiye Avrupa Konseyi İstanbul Sözleşmesini imzalayan ve aşağıda resmi gazetede görüldüğü gibi onaylayan ilk ülke oldu. Ancak Sözleşmeyle ilgili bir şeyi gözden kaçırmamız lazım.

 

SÖZLEŞME Avrupa Konseyinde henüz yürürlüğe girmedi. Sözleşmenin yürürlüğe girmesi için 75. maddesindeki sürecin tamamlanması gerekir. 75. madde gereğince, sekizi Avrupa Konseyi üyesi olmak üzere on devlet onayladıktan sonraki üç aylık sürenin sonunu takip eden ayın ilk günü yürürlüğe girecektir.

 

Eğer Sözleşme Avrupa Konseyinde yürürlüğe girmiş olsaydı, Türkiye açısından TBMM'de onaylanmasının ardından Avrupa Konseyi Genel Sekreterliğine onay belgesinin verildiği tarihten sonraki üç aylık süre sonunu takip eden ayın ilk günü yürürlüğe girecekti. (md. 75/4)

 

Şimdi on devletin onaylaması beklenecek. 7 Kasım 2011 tarihi itibariyle Sözleşmeyi 17 ülke imzalamıştır ama henüz Türkiye dışında onaylayan olmamıştır.

KADINLARA YÖNELİK ŞİDDET VE AİLE İÇİ ŞİDDETİN ÖNLENMESİ VE BUNLARLA MÜCADELEYE İLİŞKİN AVRUPA KONSEYİ SÖZLEŞMESİNİN ONAYLANMASININ UYGUN BULUNDUĞUNA DAİR KANUN

MADDE 1 – (1) 11 Mayıs 2011 tarihinde İstanbul’da imzalanan “Kadınlara Yönelik Şiddet ve Aile İçi Şiddetin Önlenmesi ve Bunlarla Mücadeleye İlişkin Avrupa Konseyi Sözleşmesi”nin onaylanması uygun bulunmuştur.;

 

MADDE 2 – (1) Bu Kanun yayımı tarihinde yürürlüğe girer.;

 

MADDE 3 – (1) Bu Kanun hükümlerini Bakanlar Kurulu yürütür. 29/11/2011

 

Sözleşme:

 

 Madde 75 – İmzalama ve yürürlüğe girme

 

1. Bu Sözleşme Avrupa Konseyi üyelerinin ve Sözleşme’nin hazırlanmasına katılan üye olmayan ülkelerin ve Avrupa Birliği’nin imzasına açıktır.

 

2. Bu Sözleşme kabule veya onaya tabidir. Kabul veya onay belgeleri Avrupa Konseyi Genel Sekreteri’ne verilir.

 

3. Bu Sözleşme 2. fıkranın hükümleri uyarınca, Sözleşme tarafından bağlı kılınma rızalarını açıklayan en az sekizi Avrupa Konseyi üyesi olan on Devlet tarafından imzalanmasından sonraki üç aylık süre sonunu takiben ayın ilk günü yürürlüğe girer.

 

4. 1. fıkrada bahsedilen, sonradan Sözleşme tarafından bağlı kılınma rızasını açıklayan her devlet ve Avrupa Birliği açısından Sözleşme, kabul veya onay belgelerinin verildiği tarihten sonraki üç aylık süre sonunu takiben ayın ilk günü yürürlüğe girer.

 

Article 75 – Signature and entry into force

 

1 - This Convention shall be open for signature by the member States of the Council of Europe, the non-member States which have participated in its elaboration and the European Union.

 

2 - This Convention is subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

 

3 - This Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date on which 10 signatories, including at least eight member States of the Council of Europe, have expressed their consent to be bound by the Convention in accordance with the provisions of paragraph 2.

 

4 - In respect of any State referred to in paragraph 1 or the European Union, which subsequently expresses its consent to be bound by it, the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of the deposit of its instrument of ratification, acceptance or approval.

 

Article 76 – Accession to the Convention

 

1 - After the entry into force of this Convention, the Committee of Ministers of the Council of Europe may, after consultation of the Parties to this Convention and obtaining their unanimous consent, invite any non-member State of the Council of Europe, which has not participated in the elaboration of the Convention, to accede to this Convention by a decision taken by the majority provided for in Article 20.d of the Statute of the Council of Europe, and by unanimous vote of the representatives of the Parties entitled to sit on the Committee of Ministers.

 

2 - In respect of any acceding State, the Convention shall enter into force on the first day of the month following the expiration of a period of three months after the date of deposit of the instrument of accession with the Secretary General of the Council of Europe.
